Terms of Service — Mitchell Burns / Burns Media Group Pty Ltd
This website is operated by Burns Media Group Pty Ltd, trading under the Mitchell Burns brand.
By placing an order through this website, you agree to these Terms, together with our Refund Policy, Shipping Policy and Privacy Policy.
Prices and availability may change without notice before an order is accepted. The currency and final amount payable will be displayed during checkout. Where applicable, Australian prices are presented inclusive of GST.
An order is subject to acceptance by BMG. We may cancel and refund an order where an artwork is unavailable, an edition has sold out, an obvious pricing or technical error has occurred, or we cannot reasonably fulfil the order. Nothing in these Terms limits rights available under applicable consumer law.
Fine-art works are produced to order. Artwork sizes, edition information and available presentation options are shown on the relevant product page. Reasonable production tolerances may occur.
Limited and exclusive editions are subject to the edition information shown for the relevant artwork. Where applicable, edition numbering refers to the edition structure offered by BMG.
Purchase of a physical artwork transfers ownership of that physical copy only. All copyright, reproduction rights, intellectual property rights and rights in the underlying photograph remain with Mitchell Burns and/or Burns Media Group Pty Ltd unless expressly agreed otherwise in writing. Artwork may not be reproduced, commercially exploited, scanned for reproduction, licensed or used to create derivative commercial works without permission.
Images displayed on the website are intended to represent the artwork accurately; however, screen calibration and device settings can affect colour appearance.
To the maximum extent permitted by law, BMG is not liable for indirect or consequential losses arising solely from use of the website. Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy that cannot legally be excluded under the Australian Consumer Law or other applicable legislation.
These Terms are governed by the laws applying in Queensland, Australia, without limiting any mandatory rights available to consumers in another jurisdiction.
Photography Expeditions require separate booking terms and conditions. Expedition-specific terms dealing with cancellation, deposits, minimum numbers, itinerary changes, travel insurance, weather, participant responsibilities and other travel matters will apply separately.
