Photography Expedition Booking Terms
Photography Expeditions offered by Mitchell Burns / Burns Media Group Pty Ltd (“BMG”) are small-group photographic travel experiences. By completing a booking, the participant agrees to these Booking Terms in addition to the general website Terms of Service.
Booking and payment
A place is confirmed once the advertised booking amount has been successfully paid and BMG has accepted the booking. Unless otherwise stated for a particular departure, prices are per person and include only the items specifically listed as included on the relevant expedition page.
Participant cancellations
If you need to cancel, you must notify BMG in writing as soon as possible. Because accommodation, transport, guides and other expedition services may be committed in advance, cancellation costs may apply.
Where possible, BMG will seek to minimise cancellation losses and may offer a refund, partial refund, transfer or credit depending on the timing of cancellation and the costs already committed or incurred. Where a cancelled place can reasonably be resold, BMG will take this into account when determining any amount retained.
Any cancellation amount retained will reflect reasonable administration, non-refundable supplier costs and other losses arising from the cancellation. Nothing in these terms excludes rights that cannot lawfully be excluded.
Cancellation or postponement by BMG
An expedition may be cancelled or postponed if minimum participant numbers are not reached, if Mitchell Burns is unable to lead the expedition, or where weather, safety, access, natural events, supplier failure or other circumstances make the expedition impractical or unsafe.
If BMG cancels an expedition and does not offer an acceptable replacement or rescheduled departure, amounts paid directly to BMG for the expedition will be refunded.
BMG is not responsible for separately booked flights, accommodation, rental vehicles, visas or other personal travel expenses. Participants should book flexible travel arrangements and maintain suitable travel insurance.
Minimum numbers
Expeditions may require a minimum number of participants to proceed. BMG will advise participants as soon as reasonably practicable if a departure cannot proceed because minimum numbers have not been reached.
Itinerary changes
Photography depends heavily on weather, wildlife, light, access and local conditions. Published itineraries are therefore indicative rather than guaranteed. BMG may alter the order, timing, route, locations, activities, accommodation or suppliers where reasonably necessary.
Where a material inclusion becomes unavailable, BMG will make reasonable efforts to provide a suitable alternative where practicable.
Weather, wildlife and photographic conditions
No particular weather conditions, wildlife sighting, photograph, sunrise, sunset or photographic outcome can be guaranteed. Part of the expedition experience involves responding to the conditions encountered in the field.
Travel insurance
Participants are strongly encouraged to hold comprehensive travel insurance appropriate to the expedition, including cancellation, medical expenses, personal belongings, photographic equipment and emergency transport where relevant.
Health, fitness and accessibility
Participants are responsible for assessing whether an expedition is suitable for their health, fitness and mobility. Some activities may involve early starts, uneven terrain, extended periods outdoors, vehicle travel, boats or remote locations.
Participants should disclose any relevant accessibility requirements before booking so BMG can determine whether reasonable arrangements can be made.
Safety and conduct
Participants must follow reasonable safety instructions given by BMG, guides, drivers, accommodation providers and activity operators. BMG may remove a participant from an activity or expedition where their behaviour creates a serious safety risk or materially disrupts the group.
Third-party operators
Expeditions may include transport providers, accommodation providers, guides, boat operators, scenic-flight operators and other independent suppliers. Their own operating conditions and safety requirements may also apply.
Photography equipment
Participants are responsible for their own cameras, lenses, computers, storage media and other personal equipment unless specifically stated otherwise. BMG is not responsible for normal loss or damage to personal photographic equipment except to the extent liability cannot lawfully be excluded.
Travel to and from the expedition
Unless specifically included in the expedition description, participants are responsible for travel to the nominated commencement point and from the finishing point.
Personal images
Participants retain ownership of photographs they create during the expedition, subject to ordinary laws and any location-specific restrictions.
BMG may photograph or film expedition activities for documentary, editorial or promotional purposes. Where an identifiable participant is intended to feature prominently in promotional material, BMG will seek appropriate consent.
Consumer rights and liability
Nothing in these Booking Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot legally be excluded under the Australian Consumer Law.
To the extent permitted by law, BMG is not responsible for losses caused by circumstances outside its reasonable control or for indirect or consequential losses that are not reasonably foreseeable.
Governing law
These Booking Terms are governed by the laws of Queensland, Australia, subject to any mandatory consumer protections that apply.
